GENERAL TERMS AND CONDITIONS OF SALE FOR INDIVIDUALS

ARTICLE 1 – SELLER IDENTIFICATION

These general terms and conditions of sale are concluded between:

Hereinafter referred to as "the Seller".

And any natural or legal person making a purchase, hereinafter referred to as "the Client".


ARTICLE 2 – PURPOSE AND SCOPE

These General Terms and Conditions of Sale (GTC) govern the sale of products by LA MAISON DU BARISTA:

They define the rights and obligations of the parties in the context of the sale of products to any client, consumer or professional.

Certain provisions, particularly those relating to the right of withdrawal, apply exclusively to sales made remotely via the website.

Sales made in a physical store do not benefit from the right of withdrawal unless a commercial gesture is made by the Seller.


ARTICLE 3 – PRODUCTS

The products offered for sale are those listed on the website within the limits of available stock.

Each product is accompanied by a description presenting its essential characteristics.

Photographs are for illustrative purposes and are not contractually binding.


ARTICLE 4 – PRICE

Prices are indicated in euros (€) all taxes included (TTC).

Delivery costs are not included and are specified before order validation.

The Seller reserves the right to modify its prices at any time. The applicable price is that displayed at the time of the order.


ARTICLE 5 – ORDER

Any order implies full and complete acceptance of these GTC.

An order confirmation is sent by email to the Client.

The Seller reserves the right to refuse or cancel any order in case of:

  • existing dispute with the Client

  • suspicion of fraud

  • payment issue.


ARTICLE 6 – PAYMENT

Payment is due immediately upon order.

Accepted payment methods are:

  • credit card (CB, Visa, Mastercard)

  • American Express

  • Apple Pay

  • PayPal

  • Shop Pay.

Payments are secured. Banking data is not retained by the Seller.


ARTICLE 7 – RETENTION OF TITLE

Products remain the property of the Seller until full payment of the price.


ARTICLE 8 – DELIVERY

Products are delivered to the address indicated during the order.

Delivery times are indicative.

In case of a delay exceeding 30 days, the Client may request the cancellation of the order and a refund.

Upon receipt of the package, the Client must check the condition of the product.

Any anomaly must be reported to the carrier and the Seller within three days.


ARTICLE 9 – RIGHT OF WITHDRAWAL (ONLINE SALES)

In accordance with articles L221-18 and following of the Consumer Code, the Client has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal.

Products must be returned:

  • in their original condition

  • complete

  • in their original packaging.


ARTICLE 10 – RETURN COSTS

Except in the case of a defective product, non-conforming product, or preparation error attributable to the Seller, return costs are the sole responsibility of the Client.

In case of defect or non-conformity, return costs may be covered by the Seller after validation by customer service.

ARTICLE 11 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to, in particular:

  • the supply of goods liable to deteriorate rapidly (especially coffee)

  • unsealed products that cannot be returned for hygiene or health protection reasons.


ARTICLE 12 – SPECIAL CONDITIONS FOR COFFEE MACHINES AND GRINDERS

Coffee machines (espresso machines, bean-to-cup espresso machines and similar equipment) and grinders (electric and manual) are subject to specific return conditions.

The right of withdrawal can only be exercised for a product that is:

  • new

  • unused

  • complete

  • in its original packaging.

No refund can be made if:

  • the machine has been put into service

  • the machine has been switched on or used

  • water is present in the circuit

  • ground coffee is present in the grinder or in the group head

  • the product is incomplete

  • the product is damaged.

After inspecting the returned product, the Seller reserves the right:

  • to refuse the refund

  • or to apply a discount corresponding to the depreciation of the product.

Specific cancellation / high-end equipment

High-end coffee machines and grinders may require specific sourcing or special preparation. As such, any order for such equipment is considered to firmly commit the Client. In the event of cancellation of an order that has already been confirmed and is in process, the seller reserves the right to retain fees corresponding to the costs actually incurred. 

These costs include, in particular:

  • transaction fees related to payment,
  • administrative and order processing fees.

Unless otherwise stated, these fees are set at a flat rate of 3% of the total order amount, with a minimum of €10.

The balance will be refunded within a maximum of fourteen (14) days from the confirmation of the cancellation. The client acknowledges having read and accepted these conditions prior to validating their order.


ARTICLE 13 – LEGAL GUARANTEES

Products benefit from legal guarantees provided by French legislation:

  • legal guarantee of conformity

  • guarantee against hidden defects.

ARTICLE 14 – LIABILITY

The Seller cannot be held responsible for:

  • improper use of the product

  • incorrect installation

  • damage resulting from the use of the internet network.


ARTICLE 15 – INTELLECTUAL PROPERTY

All elements of the site are the exclusive property of LA MAISON DU BARISTA.

Any unauthorized reproduction or use is prohibited.


ARTICLE 16 – PERSONAL DATA

The data collected is necessary for order management and commercial relations.

In accordance with the General Data Protection Regulation (GDPR), the Client has a right to access, rectify, and delete their data.

ARTICLE 17 – CONSUMER MEDIATION

In accordance with the Consumer Code, the Client has the option of free recourse to a consumer mediator to amicably resolve a dispute.


ARTICLE 18 – APPLICABLE LAW

These GTC are subject to French law.

In case of dispute, the competent courts will be those of Paris.

 

GENERAL TERMS AND CONDITIONS OF SALE FOR PROFESSIONALS

These conditions prevail over any purchase conditions of the client.

  • Retention of title: the seller retains full ownership of the equipment until full payment of the price, principal, and accessories.

  • Delivery & risks (Ex-Works): the transfer of risks occurs upon delivery of the goods to the carrier. It is the buyer's responsibility to check the condition of the equipment upon receipt and to make reasoned reservations with the carrier within 48 hours.

  • Returns & exchanges: as a professional, you do not benefit from any right of withdrawal. Equipment (machines, grinders, accessories) will not be taken back or exchanged if it has been unboxed, put into service, or used (presence of water in the circuits, coffee in the grinder, signs of use). Any return for defect requires prior written agreement.

  • Warranties: the legal guarantee of conformity is excluded for professionals. Only the manufacturer's contractual warranty (parts) is applicable. The seller's liability is strictly limited to the value of the defective product, excluding any compensation for loss of operation or profit.

  • Disputes: in case of dispute, exclusive jurisdiction is attributed to the Commercial Court of Paris.
