PART I – GENERAL TERMS AND CONDITIONS OF SALE APPLICABLE TO INDIVIDUALS (B2C)
ARTICLE 1 – SELLER IDENTIFICATION AND CONTACT

Hereinafter referred to as "the Seller".
And any natural person acting as a consumer (a natural person acting for purposes that are outside their commercial, industrial, artisanal, liberal, or agricultural activity), hereinafter referred to as "the Customer".
ARTICLE 2 – PURPOSE AND SCOPE
These General Terms and Conditions of Sale (GTC) govern all product sales made by LA MAISON DU BARISTA:

They apply to the exclusion of all other conditions. The Customer declares to have read and accepted these GTC before validating their order.
The provisions relating to the right of withdrawal (Articles 9 to 12) apply exclusively to purchases made remotely on the website. Purchases made in the physical store do not benefit from the legal right of withdrawal.
ARTICLE 3 – PRODUCTS AND AVAILABILITY
The products offered for sale are those appearing on the website on the day of its consultation by the Customer, within the limits of available stock. Each product is subject to a detailed description presenting its essential characteristics. The catalog photographs are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly regarding colors or shades of materials (wood, metal, etc.).
ARTICLE 4 – PRICE AND DELIVERY COSTS
Prices are indicated in euros (€) all taxes included (TTC), including French VAT at the legal rate in force on the day of the order. Prices do not include processing, preparation, and delivery costs, which are indicated in addition before the final validation of the order. The Seller reserves the right to modify its prices at any time. However, the product will be invoiced based on the rate in force at the time of order validation by the Customer.
ARTICLE 5 – ORDER AND VALIDATION
Any order placed on the site implies unreserved acceptance of these GTC. The order is only definitively registered after payment validation by the banking institution. A confirmation email summarizing the order (products, prices, delivery address, delivery methods) is sent to the Customer. The Seller reserves the right to refuse or cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order, or in case of legitimate suspicion of fraud.
ARTICLE 6 – PAYMENT AND SECURITY
Payment is due immediately upon order. The Customer can pay by:

Financial transactions are processed securely by our payment providers. The Seller never has access to the Customer's confidential banking data.
ARTICLE 7 – RETENTION OF TITLE
The ordered products remain the property of LA MAISON DU BARISTA until full and effective payment of their price in principal and accessories.
ARTICLE 8 – DELIVERY AND TRANSFER OF RISKS
8.1 Delivery methods and times
Products are delivered to the delivery address indicated by the Customer when placing the order. Delivery times are specified to the Customer before the order is validated.
8.2 Delivery delay
In accordance with article L216-2 of the Consumer Code, in the event of the Seller's failure to deliver on the agreed date or at the expiration of the agreed period, or failing that at the latest 30 days after the conclusion of the contract, the Customer may terminate the contract by registered letter with acknowledgment of receipt or by a written document on another durable medium, if, after having enjoined the Seller to make the delivery within a reasonable additional period, the latter has not complied.
8.3 Transfer of risks
In accordance with article L216-4 of the Consumer Code, any risk of loss or damage to the goods is transferred to the Customer when the latter, or a third party designated by him (other than the carrier proposed by the Seller), physically takes possession of these goods.
8.4 Delivery verification
It is the Customer's responsibility to check the condition of the packaging and the goods upon receipt. In case of observed damage (damaged package, open package, broken product), the Customer is invited to make precise reservations on the carrier's delivery note and to inform the Seller's customer service within 48 to 72 hours at contact@lamaisondubarista.com to facilitate insurance procedures.
ARTICLE 9 – RIGHT OF WITHDRAWAL (ONLINE SALES ONLY)
9.1 Legal period
In accordance with article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) clear days to exercise their right of withdrawal without having to give reasons or pay penalties. The period runs from the day of receipt of the product by the Customer or a designated third party. In the case of an order for several goods delivered separately, the period runs from the receipt of the last good.
9.2 Exercise modalities To exercise their right of withdrawal, the Customer must notify their decision to the Seller by means of an unambiguous statement (for example, a letter sent by post or an email to contact@lamaisondubarista.com).
9.3 Reimbursement
In the event of exercising the right of withdrawal, the Seller will reimburse the Customer for all sums paid, including standard delivery costs for the order (with the exception of additional costs resulting from the Customer's choice of a more expensive delivery method than the standard method), no later than fourteen (14) days from the date on which the Seller is informed of the Customer's decision. The Seller may defer reimbursement until the goods have been recovered or until the Customer has provided proof of shipment of these goods, the date chosen being that of the first of these facts. Reimbursement will be made using the same payment method as that used by the Customer for the initial transaction.
ARTICLE 10 – PRODUCT RETURNS AND RETURN COSTS
The Customer must return the goods to the Seller without undue delay and, at the latest, within fourteen (14) days following the communication of their decision to withdraw. The direct costs of returning the product remain the sole responsibility of the Customer, except in the event of an order preparation error or a proven defective/non-conforming product, in which case the return costs will be borne by the Seller.

ARTICLE 11 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for: 1° The supply of goods liable to deteriorate or expire rapidly (in particular roasted or ground coffee); 2° The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection (cleaning accessories, unsealed maintenance products, etc.); 3° The supply of goods made to the consumer's specifications or clearly personalized.
ARTICLE 12 – SPECIAL CONDITIONS AND DEPRECIATION: COFFEE MACHINES AND GRINDERS
In accordance with article L221-23 of the Consumer Code, the Customer's liability is only engaged with regard to the depreciation of the good resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of this good.
To benefit from a full refund under the right of withdrawal, coffee machines (espresso, grinders) and electric or manual grinders must be returned:

In their original new condition,

Complete (accessories, manuals, filters, cables),
-
And in their intact original packaging.
In the event that the returned product has been used beyond a simple test to verify its proper functioning (in particular if the machine shows traces of coffee in the grinder/group, limescale deposits, or residual water in the hydraulic circuit), a depreciation proportional to the costs of refurbishment, professional cleaning, reconditioning, or the depreciation of the market value of the product may be applied and deducted from the refund.
ARTICLE 13 – LEGAL GUARANTEES
The Seller is liable for defects in conformity of the goods with the contract under the conditions of article L217-3 et seq. of the Consumer Code and for hidden defects of the sold item under the conditions provided for in articles 1641 et seq. of the Civil Code.

ARTICLE 14 – LIABILITY
The Seller cannot be held responsible for damages resulting from improper use of the product by the Customer, non-compliance with the maintenance and use instructions provided in the manufacturer's manual, or normal wear and tear of the product. The Seller cannot be held responsible for inconveniences or damages inherent in the use of the Internet (service interruption, external intrusion, presence of computer viruses).
ARTICLE 15 – INTELLECTUAL PROPERTY
All elements of the website https://www.lamaisondubarista.com (texts, visuals, logos, brands, structures) are the exclusive property of LA MAISON DU BARISTA or its partners. Any reproduction, exploitation, or use for any purpose whatsoever, even partially, is strictly prohibited without prior written agreement.
ARTICLE 16 – PERSONAL DATA AND CONFIDENTIALITY
The Seller collects the Customer's personal data necessary for processing their order and managing the commercial relationship. In accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act, the Customer has a right of access, rectification, erasure, limitation, and opposition to the processing of their personal data. To exercise these rights, the Customer can send an email to: contact@lamaisondubarista.com. For more information, the Customer is invited to consult our Privacy Policy accessible on the website.
ARTICLE 17 – CONSUMER MEDIATION AND DISPUTE RESOLUTION
In accordance with articles L.612-1 et seq. of the Consumer Code, the Customer has the right to have recourse free of charge to a consumer mediator for the amicable resolution of a dispute with the Seller.
17.1 Prior complaint
In case of dispute or complaint, the Customer should first contact LA MAISON DU BARISTA customer service to seek an amicable solution:

17.2 Consumer mediation
In accordance with articles L.612-1 et seq. of the Consumer Code, in the event of failure of the complaint request to customer service or in the absence of a response within two (2) months, the consumer Customer may resort free of charge to a consumer mediator for the amicable resolution of the dispute.
The contact details of the consumer mediator associated with LA MAISON DU BARISTA will be provided to the Customer upon request.
17.3 European Online Dispute Resolution (ODR) Platform
In accordance with article 14 of Regulation (EU) No 524/2013, the Customer is also informed that they can submit their dispute on the European Online Dispute Resolution (ODR) platform accessible at the following address: https://ec.europa.eu/consumers/odr/
ARTICLE 18 – APPLICABLE LAW AND COMPETENT JURISDICTION
These GTC are subject to French law. In case of dispute, an amicable solution will be sought first before any legal action. In the absence of an amicable agreement or resolution via mediation, the French courts will have sole jurisdiction, in accordance with the rules of the Code of Civil Procedure and the Consumer Code.
ARTICLE 19 – SPECIFIC CONDITIONS AND LIMITATIONS APPLICABLE TO SALES AND DELIVERIES OUTSIDE THE EUROPEAN UNION (EXPORT / INTERNATIONAL)
19.1 Applicable law and inapplicability of foreign local laws
For any order delivered outside the territory of the European Union (notably in the United States, Canada, United Kingdom, Switzerland, etc.), this contract is exclusively governed and interpreted according to French law, in accordance with Article 18. The Customer expressly acknowledges that the laws, local regulations, or commercial practices in force in their country of residence relating to consumer protection - including, but not limited to, satisfaction guarantees, extended return policies, or local rights of withdrawal - do not apply to this contract.
19.2 Strict limitation of the Right of Withdrawal and prohibition of returns for extended use
The right of withdrawal granted to Customers residing outside the European Union is strictly limited to the French legal period of fourteen (14) days from the receipt of the product, as defined in Article 9 of these GTC.
No return, refund, or exchange will be accepted:

Beyond the legal period of fourteen (14) days from delivery;
-
For a product that has been used, tested for an extended period, or put into service (in particular if the machine shows traces of water in the hydraulic circuit or coffee residues in the grinders/mills);
-
Under a "satisfaction guarantee" or an extended trial period (e.g., 30, 60, or 90 days), LA MAISON DU BARISTA not offering any free trial period on its equipment.
Any return request made by a Customer beyond the 14-day period, or concerning a used product, will be strictly refused.
19.3 Technical standards and electrical compatibility
Equipment sold on the site (coffee machines, electric grinders) is supplied for the European market and complies with European technical and electrical standards (220–240 V ~, 50/60 Hz, type E/F plugs).

Products must only be operated using an electrical supply compatible with the voltage and frequency specified by the manufacturer. A plug adapter does not convert voltage or frequency. La Maison du Barista does not represent that a voltage transformer makes a European appliance compatible with US electrical systems.

The use of a voltage transformer, converter, or adapter is at the sole responsibility of the Customer.

Damage caused to the electrical or electronic components of the machine by connection to a non-compliant electrical network or by the use of an inadequate voltage converter constitutes misuse and is not covered by any legal or commercial warranty (in accordance with Article 13).
19.4 Customs duties, import taxes, and refusal fees
The prices displayed on the website for deliveries outside the European Union do not include customs duties and local VAT. All customs duties, import taxes, customs clearance fees, and local taxes applicable in the country of destination are the sole responsibility of the Customer and are collected directly by the carrier or local customs authorities.
In case of refusal of the package by the Customer upon delivery (particularly due to refusal to pay customs duties or import taxes) or in case of impossibility of delivery attributable to the Customer:

Round-trip transportation costs,

As well as all customs and storage fees advanced or invoiced to the Seller, will be automatically deducted from the amount of any refund for the order.
19.5 Return procedure from abroad
In the event of a return authorized by customer service (in strict compliance with the 14-day period and for a new product), the Customer must imperatively affix the mention: "RETURN MERCHANDISE - RETURN TO SENDER - ORIGIN FRANCE" on the package and on the customs declaration. Any customs fees or taxes re-imposed on LA MAISON DU BARISTA upon re-entry of the package into French territory due to an error in the Customer's declaration will be withheld from the refund.
PART II – GENERAL TERMS AND CONDITIONS OF SALE APPLICABLE TO PROFESSIONALS (B2B)
ARTICLE 1 – SCOPE OF APPLICATION AND ENFORCEABILITY
These General Terms and Conditions of Sale for Professionals (hereinafter "B2B GTC") apply to all sales of products and equipment concluded by the company LA MAISON DU BARISTA SAS (RCS Paris 820 918 407) to any professional buyer (natural or legal person acting within the scope of their commercial, industrial, craft, liberal, or agricultural activity), hereinafter referred to as "the Professional Customer."
In accordance with Article L. 441-1 of the French Commercial Code, these B2B GTC constitute the sole basis of the commercial negotiation. Any order for products implies the unreserved acceptance by the Professional Customer of these B2B GTC, which prevail over all purchasing conditions, unless a formal and written derogation is granted by LA MAISON DU BARISTA.
ARTICLE 2 – ORDERS AND AVAILABILITY
Orders are placed on the website https://www.lamaisondubarista.com or by any other written means (signed quote, purchase order). Any order placed by the Professional Customer is firm, final, and irrevocable upon validation. No withdrawal or modification of an order may occur without the prior written agreement of LA MAISON DU BARISTA.
ARTICLE 3 – ABSENCE OF RIGHT OF WITHDRAWAL
In accordance with current regulations, the Professional Customer does not benefit from any right of withdrawal. Sales concluded between professionals are final upon validation of the order. No return, exchange, or refund is accepted outside of cases of implementation of contractual guarantees or hidden defects referred to in Article 9.
ARTICLE 4 – PRICES AND PAYMENT TERMS
4.1 Prices Product prices are indicated in Euros (€) excluding taxes (HT). VAT at the legal rate in force, as well as delivery, specific packaging, or customs clearance costs, are invoiced in addition and indicated before final validation of the order.
4.2 Payment Payments are due cash upon order, unless specific payment terms are expressly granted in writing by LA MAISON DU BARISTA. Accepted payment methods are credit card, bank transfer, and secure payment solutions available on the website.
4.3 Delays and payment penalties In accordance with Articles L. 441-10 and D. 441-5 of the French Commercial Code:

Any delay in payment automatically entails, from the day following the invoice due date and without prior formal notice being necessary, the application of late payment penalties calculated at a rate of three times (3x) the legal interest rate in force.

In addition, a fixed indemnity for recovery costs of 40 (forty) Euros is due by right for each invoice paid late. If the recovery costs actually incurred are higher than this fixed amount, additional compensation may be requested with supporting documents.

In case of late payment, LA MAISON DU BARISTA reserves the right to suspend the execution of all current orders of the Professional Customer and to declare the maturity of all outstanding debts.
ARTICLE 5 – RETENTION OF TITLE
LA MAISON DU BARISTA RETAINS FULL AND EXCLUSIVE OWNERSHIP OF THE PRODUCTS AND EQUIPMENT SOLD UNTIL FULL PAYMENT OF THE PRICE IN PRINCIPAL, TAXES, AND ACCESSORIES. In the event of safeguard, recovery, or judicial liquidation proceedings affecting the Professional Customer, LA MAISON DU BARISTA may claim unpaid goods in accordance with legal provisions.
ARTICLE 6 – DELIVERY AND TRANSFER OF RISKS (EX-WORKS / FACTORY DEPARTURE)
6.1 Transfer of risks
Unless otherwise expressly agreed in writing, the transfer of risks of loss, theft, damage, or destruction of goods occurs upon delivery of the products to the carrier or upon making the products available in our premises/warehouses, before their loading. The products travel at the exclusive risks of the Professional Customer.
6.2 Delivery times
Delivery times indicated during the order are given for purely indicative purposes. Delays cannot give rise to damages, payment retentions, or cancellation of current orders by the Professional Customer.
ARTICLE 7 – RECEIPT OF GOODS AND CLAIMS
7.1 Inspection upon delivery
It is the responsibility of the Professional Customer to check the condition of the packages, the number of items, and the conformity of the equipment upon receipt.
7.2 Reservations and notifications
In case of damage, missing product, or damage suffered during transport, the Professional Customer must:

Make reasoned, precise, and complete reservations on the carrier's delivery receipt;

Confirm these reservations to the carrier by registered letter with acknowledgment of receipt (LRAR) within three (3) working days following receipt of the goods, in accordance with Article L. 133-3 of the French Commercial Code;

Send a copy of this letter and the delivery note to LA MAISON DU BARISTA at contact@lamaisondubarista.com within the same period.
Failure to comply with this procedure will deem the equipment compliant and free from any apparent defect, and the responsibility of LA MAISON DU BARISTA or the carrier cannot be engaged.
ARTICLE 8 – EQUIPMENT RETURNS
No return of product or equipment will be accepted without the prior, explicit, and written agreement of LA MAISON DU BARISTA. Any return made without this agreement will be refused and sent back at the Professional Customer's expense. Equipment (espresso machines, grinders, mills) that has been unboxed, connected to water or electricity, or has contained coffee can under no circumstances be returned or taken back.
ARTICLE 9 – EQUIPMENT WARRANTIES AND LIABILITY
9.1 Exclusion of legal consumer warranties
The legal guarantee of conformity provided for in Articles L. 217-1 et seq. of the French Consumer Code is expressly excluded for purchases made by Professional Customers.
9.2 Manufacturer's warranty / spare parts
Coffee machines and professional or semi-professional equipment are covered by the manufacturer's contractual warranty (generally limited to the supply of defective spare parts for a period of 1 year, excluding labor and travel, unless a specific maintenance contract is in place). The warranty does not cover:

Normal wear and tear of parts (seals, shower screens, grinder burrs, etc.);

Breakdowns and scaling due to the use of unfiltered water or water not conforming to the manufacturer's recommendations;
-
Damage resulting from negligence, improper electrical/hydraulic installation, abnormal use, or non-compliance with instruction manuals.
9.3 Limitation of liability
LA MAISON DU BARISTA'S LIABILITY IS STRICTLY LIMITED TO THE REPLACEMENT OR REPAIR OF DEFECTIVE PARTS OR PRODUCTS RECOGNIZED AS SUCH. IN NO EVENT SHALL LA MAISON DU BARISTA BE HELD RESPONSIBLE FOR INDIRECT, INTANGIBLE, OR CONSEQUENTIAL DAMAGES, SUCH AS LOSS OF OPERATION, LOSS OF TURNOVER, LOSS OF PROFIT, OR COMMERCIAL HARM SUFFERED BY THE PROFESSIONAL CUSTOMER OR THIRD PARTIES.
ARTICLE 10 – SALES DELIVERED OUTSIDE THE EUROPEAN UNION (B2B EXPORT)
For all orders delivered outside the customs territory of the European Union:

Sales are concluded ex-tax, with import taxes, customs duties, and customs clearance fees remaining the exclusive responsibility of the buyer.

The Professional Customer is responsible for compliance with safety and electrical approval standards applicable in the country of destination.
ARTICLE 11 – APPLICABLE LAW AND JURISDICTION
THESE B2B GTC AND THE SALES RESULTING THEREFROM ARE GOVERNED EXCLUSIVELY BY FRENCH LAW, TO THE EXCLUSION OF THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS (CISG).
IN THE EVENT OF A DISPUTE RELATING TO THE FORMATION, EXECUTION, INTERPRETATION, OR RESOLUTION OF THESE B2B GTC OR ORDERS PLACED PURSUANT THERETO, EXCLUSIVE JURISDICTION IS ATTRIBUTED TO THE PARIS COMMERCIAL COURT, EVEN IN THE EVENT OF SUMMARY PROCEEDINGS, THIRD-PARTY PROCEEDINGS, OR MULTIPLE DEFENDANTS.
